FULLY BOOKED Legal Rights of Unmarried Parents Including Cohabiting Parents

This seminar will clarify the legal situation regarding guardianship, access, custody, maintenance, birth registration, establishing paternity, passports and cohabitation. Workshop participants will increase their understanding of the legal complexities of co-parenting between unmarried parents & get practical hints on how to make shared parenting work.

The legal situation of unmarried parents is different to that of married parents. Recently enacted (but not yet commenced) legislation will radically change family law in this area. The seminar will brief participants on the key changes to be introduced when the following two pieces of legislation are commenced.


The Children and Family Relationships Act 2015 will introduce many changes to family law, to include the following: - cohabiting fathers (living with the mother for 12 months, 3 of which must be post the birth) will have automatic guardianship rights in relation to their child - parents will be able to sign up for guardianship rights at the time of birth registration.
The Civil Registration (Amendment) Act 2014 will, among other changes, make it compulsory to register the father's name on his child's Birth Certificate (there will be exceptions).
